If your employer carries workers compensation insurance in Texas, then you may be barred from bringing a negligence action. In these situations, you would follow the procedures for your company’s worker compensation plan. However, if the injury is the result of a third party or your company does not carry workers compensation insurance, you may still be able to bring an action for negligence.
