In this instance, where the deceased was a passenger in the intoxicated driver’s vehicle, the victim may be able to bring a claim against the driver themselves. Additionally, depending on the events before the collision, a Dram Shop claim could be brought against any possible third party who may have contributed to the intoxication of the driver. These types of claims are very difficult to navigate and are very fact dependent claims.
